This Training & Certification Agreement (“Agreement”) governs enrollment in and participation in all professional training, certification programs, workshops, and educational resources (“Programs”) offered by C.L.E.A.N. Tobacco Recovery System and Guzalia Davis (“Provider,” “We,” “Us”).

By enrolling in any C.L.E.A.N. training or certification program, you (“Student,” “Participant,” or “User”) agree to be legally bound by this Agreement.

1. Program Purpose & Scope

C.L.E.A.N. programs provide professional education in tobacco cessation, behavioral change, hypnosis-informed interventions, and recovery coaching methods. Programs are designed for vocational and educational purposes only. They do not constitute medical, psychological, or addiction treatment training and do not authorize the practice of medicine, psychotherapy, or counseling.

Certification reflects successful completion of internal training standards and does not constitute government licensure.

2. Eligibility & Professional Readiness

Age Requirement: Participants must be at least eighteen (18) years of age.

Mental & Emotional Stability: Participants warrant that they are not experiencing untreated psychosis, schizophrenia, or severe psychiatric conditions that may interfere with participation.

Professional Responsibility: Participants acknowledge that certification requires ethical conduct, emotional maturity, and independent professional judgment.

The Provider reserves the right to deny or revoke enrollment if participation presents risk to the Student or program integrity.

3. Program Structure & Learning Format

Programs are competency-based.

Enrollment does not include individual therapy, personal coaching, or clinical supervision unless explicitly stated in writing.

Access to Materials: Participants receive access to digital content, recorded sessions, manuals, and instructional resources through approved platforms.

Access duration is defined by the specific program purchased.

Support Scope: Support is limited to curriculum clarification and technical assistance. Participants must initiate support requests through email: info@cleantobaccorecovery.com.

4. Certification Requirements

Certification may require:

  • Completion of assigned coursework

  • Attendance at required sessions (live or recorded)

  • Submission of written or practical assessments

  • Demonstration of ethical conduct

  • Full payment of all fees

The Provider retains sole authority to determine certification eligibility and standards.

Failure to meet requirements may result in denial or delay of certification without refund.

5. No Professional License or Franchise Rights

Certification confirms completion of C.L.E.A.N. training standards only.

It does not grant:

  • Franchise rights

  • Training authority

  • Instructor status

  • Licensing privileges

  • Organizational representation rights

Participants are not authorized to train, certify, sublicense, or represent others on behalf of C.L.E.A.N.

6. Intellectual Property & Usage Rights

Ownership: All course content, frameworks, manuals, protocols, recordings, and methodologies remain the exclusive intellectual property of the Provider.

Permitted Use: Participants may apply learned techniques in private professional practice with their clients.

Prohibited Use: Participants may not:

  • Reproduce or distribute written materials

  • Sell or share course content

  • Publish scripts verbatim

  • Upload recordings to public platforms

  • Create derivative training programs

  • Offer “C.L.E.A.N.-based” certifications

Attribution: Participants may state that they are “C.L.E.A.N.-Certified Practitioners” only while certification remains active and in good standing.

Misrepresentation of credentials is prohibited.

7. Professional Conduct & Ethics

Participants agree to maintain professional integrity.

Prohibited conduct includes:

  • Harassment or abuse

  • Boundary violations

  • Dishonesty

  • Disruption of learning environments

  • Misuse of authority with clients

  • Misrepresentation of services

Violations may result in suspension or revocation of certification.

8. Communication & Technical Responsibility

Participants are responsible for maintaining functional access to email and learning platforms.

Blocking official communications constitutes voluntary loss of access.

The Provider is not responsible for missed sessions or materials due to user-side technical issues.

Account deletion results in permanent loss of records and credentials.

9. Financial Terms & Refund Policy

Digital Program Policy: All programs involve access to proprietary materials. All sales are final. No refunds, exchanges, or cancellations are permitted.

Payment Plans: Missed payments result in automatic suspension. Prior payments are non-refundable.

Certification Issuance: Certification is issued only after full payment is received.

10. Results Disclaimer

The Provider makes no guarantees regarding:

  • Client outcomes

  • Professional success

  • Income generation

  • Practice growth

  • Personal results

Success depends on individual skill, ethics, and effort.

11. Termination & Revocation

The Provider may terminate enrollment or revoke certification for:

  • Policy violations

  • Ethical breaches

  • Intellectual property misuse

  • Misrepresentation

  • Harmful conduct

Termination results in loss of access without refund.

12. Limitation of Liability & Indemnification

The Provider is not liable for any damages arising from application of training methods.

Participants agree to indemnify and hold harmless the Provider from claims arising from their professional practice.

13. Modifications to Agreement

The Provider may update this Agreement at any time.

Revisions become effective upon posting.

Continued participation constitutes acceptance.

14. Governing Law & Jurisdiction

This Agreement is governed by the laws of the United States and the State of Pennsylvania.

All disputes shall be resolved exclusively in courts located therein.
